2. Scope

These General Terms and Conditions apply to all orders placed in the HYPELUV online shop unless otherwise agreed in writing.

3. Conclusion of Contract

By submitting an order, the customer makes a binding offer to purchase the goods contained in the shopping cart. HYPELUV accepts the offer by sending an order confirmation via email or by dispatching the goods.

4. Prices and Payment Terms

All prices include the statutory VAT. During the ordering process, the customer can choose from the available payment methods. Currently, HYPELUV accepts the following payment methods:

  • Credit Card (Visa, Mastercard, American Express)

  • PayPal

  • Sofortüberweisung (Klarna Sofort)

  • Klarna Invoice

  • Klarna Installment

  • BLIK (only for customers with a bank account in Poland)

5. Delivery and Shipping

Shipping is carried out from Germany. Delivery times are indicated on the respective product pages. Shipping costs are shown separately. For deliveries to countries outside Poland, additional taxes and customs fees may apply and must be borne by the customer.

6. Retention of Title

The delivered goods remain the property of HYPELUV until full payment has been made.

7. Inspection of Goods

All products are 100% original and not imitations. We inspect all items for visible defects before shipping. If there are any issues, please contact us at support@hypeluv.com.

8. Right of Withdrawal

Consumers have the right to withdraw from the contract within 14 days without giving reasons. The right of withdrawal information is provided during the ordering process.

9. Warranty and Liability

The statutory warranty applies. HYPELUV is liable only for damages caused by intent or gross negligence. Liability for consequential damages is excluded.

10. Data Protection

Customer information is not shared with third parties.

12. Dispute Resolution and Arbitration

Consumers have the option to resolve disputes via the EU online platform for dispute resolution (ODR platform): https://ec.europa.eu/consumers/odr/
HYPELUV does not participate in any alternative dispute resolution procedure according to § 36 VSBG.

13. Final Provisions

The law of the Republic of Poland applies, excluding the UN Sales Convention.
For consumers, this choice of law applies only insofar as it does not deprive the protection of the law of their country of residence.

For entrepreneurs, legal entities under public law or public law special funds, the exclusive place of jurisdiction is the business location of HYPELUV in Poland. The same applies if the entrepreneur does not have a general place of jurisdiction in Poland or if their residence or habitual abode is unknown at the time the action is brought.
